The Appellate Division’s Chamber Court has issued a stay on the High Court's recent order to halt the operation of battery-powered rickshaws in Dhaka within three days. The ruling, delivered by Justice Md. Rezaul Haque on Monday, ensures that these rickshaws can operate without legal hindrance for the next month. The High Court has also been directed to dispose of the related rule within this period.
Attorney General Md. Asaduzzaman and Additional Attorney General Arshadur Rauf represented the state, while Barristers H.M. Sanjid Siddiqui and Tahsina Tasnim Mridhu argued for the petitioners. Barrister Ruhul Kuddus Kajal represented the general public.
Following the hearing, Barrister H.M. Sanjid Siddiqui stated, "The Chamber Court’s stay order ensures that battery-powered rickshaws can continue to operate in Dhaka legally." State representatives also confirmed this interpretation.
Earlier in the day, the government filed an appeal against the High Court’s November 19 directive, which had ordered the cessation of battery-powered rickshaws in Dhaka within three days. The High Court had also issued a rule asking authorities to explain why their inaction in banning these rickshaws should not be deemed unlawful.
Respondents to the High Court directive include the Home Secretary, Local Government Secretary, Inspector General of Police, Dhaka’s Police Commissioner, and both Dhaka city corporations. They were instructed to enforce the ban.
The High Court order followed a petition filed by Jahurul Islam Masum and Md. Momin Ali, president and secretary of the Greater Dhaka City Pedal Rickshaw Owners Association, respectively, seeking a complete ban on battery-powered rickshaws in Dhaka city.
