Chief Justice Stresses Judicial Reforms to Align with Evolving Economy

Moulvibazar, Jan 25 — Chief Justice Dr. Syed Refaat Ahmed has emphasized the importance of adapting Bangladesh's judiciary to meet the demands of a dynamic economy. Speaking at a seminar titled "Judicial Independence and Efficiency in Bangladesh," jointly organized by the Supreme Court and the United Nations Development Programme (UNDP) Bangladesh, he outlined key reform initiatives aimed at creating a more investment-friendly judicial system.

The seminar, held at the Dusai Resort in Moulvibazar, was presided over by Senior Justice of the Appellate Division, Md. Ashfaqul Islam. In his address, the Chief Justice highlighted ongoing institutional reforms and future plans for enhancing judicial efficiency and independence.

Dr. Refaat Ahmed announced the establishment of specialized commercial courts as part of broader judicial reforms. These courts, designed to expedite the resolution of commercial disputes, aim to boost investor confidence and attract foreign direct investment (FDI). He described these courts as a critical step toward making Bangladesh a more attractive destination for both domestic and international investors.

He further stressed the inclusion of constitutional education in school curricula to instill a sense of commitment to the rule of law among younger generations. Referring to the socio-political movements of 2024, he stated that the youth’s awareness and dedication to upholding constitutional principles could be harnessed to build a more equitable and democratic society.

The Chief Justice also discussed strides toward the digitalization of the judiciary. He pointed out the implementation of paper-free operations in the Supreme Court's company bench and expressed plans to extend similar initiatives to district courts. He noted that the Supreme Court’s helpdesk is already playing an effective role in delivering transparent and accountable services to litigants.

As part of the judicial reform roadmap, Dr. Refaat Ahmed highlighted significant advancements, including the promulgation of an ordinance establishing a Judicial Appointment Council for the recruitment of higher court judges. He also mentioned progress in setting up a Supreme Court Secretariat, which is expected to streamline administrative operations within the judiciary.

The Chief Justice underscored ongoing efforts to introduce fellowships for judicial officers and develop policies for judge transfers and promotions. He also pointed out the necessity of revisiting several provisions of Chapter One of Part VI of the Constitution to enhance the judicial framework.

He directed Justice Md. Ashfaqul Islam to explore the feasibility of appointing additional judges and holding High Court sessions outside Dhaka to decentralize access to justice. Dr. Refaat Ahmed asserted that the judiciary's structure could be further strengthened through the enactment of necessary rules under Article 107 of the Constitution.

Judicial officials from Sylhet, Habiganj, and Moulvibazar attended the seminar, which was finalized under the guidance of the Ministry of Law, Justice, and Parliamentary Affairs’ training division on January 16.
